New York City Mayor Zohran Mamdani has admitted that the city does not possess the legal capability to detain Israeli Prime Minister Benjamin Netanyahu if he visits the United States later this year. In a video shared on social media, Mamdani explained that after reviewing the legal avenues concerning the International Criminal Court’s arrest warrant for Netanyahu, it was determined that New York City does not have the jurisdiction to enforce it.
Despite this limitation, Mamdani urged the U.S. federal government to acknowledge the warrant issued by the ICC and take appropriate action. He labeled Netanyahu a war criminal and asserted that neither the Israeli Prime Minister nor any individual facing similar accusations should feel welcome in New York City. Netanyahu is scheduled to visit New York in September to participate in the United Nations General Assembly. During his campaign for mayor, Mamdani had promised to seek methods to uphold the ICC warrant should Netanyahu come to the city.
The International Criminal Court issued an arrest warrant for Netanyahu in 2024, citing alleged war crimes. However, the United States does not acknowledge the court’s jurisdiction and is not a member state of the ICC. This legal standing complicates efforts by local authorities like those in New York to take direct action against Netanyahu based on the ICC’s directives.
Former U.S. President Donald Trump responded to Mamdani’s statements by criticizing the mayor’s position and maintaining that Netanyahu would not be subject to arrest on American soil. Trump defended the actions of the Israeli leader, suggesting that the remarks from Mamdani were misplaced.
In response to the ongoing discourse, Netanyahu has downplayed the situation, expressing that he is unconcerned by the comments made by the New York City mayor.
